1. Identification and scope
This website (privilegegarden.pt and its subdomains) is operated by Privilege Garden, Unipessoal, Lda., NIPC 514854235, with registered office at Avenida 31 de Janeiro, n.º 80, Braga, Portugal, as the developer of the Privilege Gardens project. Construction is carried out by Group Prodescon & Amil, under public licence no. 106513.
The website is purely informational and is intended to present the development and to allow commercial contact. Use of the site implies acceptance of these Terms and Conditions.
2. Informational nature of the content
The information provided on this site, including project descriptions, plans, images, videos, areas, finishes, delivery dates and prices, is for information purposes only and does not constitute a binding offer or contractual proposal under Article 230 of the Portuguese Civil Code.
Any reservation or acquisition of an apartment is governed by the agreements to be entered into, namely the reservation contract and the promissory sale agreement, which prevail over any communication published on this site.
3. Images and project renderings
Images, three-dimensional renderings and floor plans shown on the site are illustrative. They may include simulations of furniture, lighting, vegetation and urban context that do not necessarily reflect the final state of the works.
Some visual content may have been generated or retouched using post-production or artificial-intelligence tools for commercial communication purposes. The contractually binding elements are those defined in the finishes schedule and in the contractual documents handed over at the time of reservation.
4. Sales and commercialization
The development is marketed directly by the developer, Privilege Garden, Unipessoal, Lda. No third-party real-estate brokerage is involved.
5. Prices and additional costs
Prices shown on the site refer to the apartments available at the table update date and are subject to change without notice until the signing of the promissory sale agreement.
Unless otherwise expressly stated, prices shown do not include:
- Property Transfer Tax (IMT);
- Stamp Duty;
- Notarial fees and expenses, land registry and any bank financing costs;
- Other applicable taxes or legal charges related to the transfer.
We recommend obtaining independent legal and tax advice before any acquisition decision.
6. Distance contracting
Information requests sent through this site do not in themselves constitute a purchase or reservation contract. Any contract producing full legal effects requires a written instrument signed by the parties, in the form required by law, and is subject to Portuguese Decree-Law 24/2014 of 14 February on distance contracts where applicable.
7. Intellectual property
All content on the site (text, images, videos, plans, logos, trademarks, graphic identity) is owned by Privilege Garden, Unipessoal, Lda. or by its respective holders, and is protected by the Portuguese Copyright and Related Rights Code and by the Industrial Property Code.
No reproduction, distribution, communication to the public or modification of this content is permitted without prior and express authorisation, save for cases legally allowed.
8. Limitation of liability
Privilege Garden, Unipessoal, Lda. uses its best efforts to ensure that the information provided is accurate, complete and up to date. Nevertheless, it cannot guarantee, in all circumstances, the absence of errors, omissions or service interruptions.
To the extent permitted by law, Privilege Garden, Unipessoal, Lda. is not liable for indirect damages, loss of profits or loss of opportunity arising from access to the site or use of the information it contains. This limitation does not exclude liability for wilful misconduct or gross negligence, nor the mandatory application of consumer protection legislation.
9. Links to external sites
The site may contain links to sites operated by third parties (for example, Google Maps, social networks, service providers). Privilege Garden, Unipessoal, Lda. does not control and is not responsible for the content of these sites, their privacy policies or their terms of use.
10. Governing law and jurisdiction
These Terms and Conditions are governed by Portuguese law. Any dispute arising from the use of the site or from the interpretation of these Terms shall be submitted to the District Court of Porto (Comarca do Porto), with express waiver of any other jurisdiction, without prejudice to mandatory rules establishing a different forum for the protection of consumers.
